FLHBA Participation Waiver
I, the undersigned parent or legal guardian, hereby grant permission for my child, (“Participant”), to participate in all activities offered or sponsored by Florida Hardballers Baseball Academy, LLC (“FLHBA”), including but not limited to practices, games, scrimmages, clinics, workouts, strength and conditioning sessions, team meetings, camps, tryouts, fundraising events, team-building activities, use of training or practice facilities, travel to and from activities (whether provided by FLHBA or arranged separately), overnight stays, and any post-season or additional tournaments or events (collectively, the “Activities”). Participation is voluntary and undertaken at the Participant’s own risk.
Medical Representation
I certify that my child is physically able to participate in the Activities and has no medical, physical, or mental condition that would increase the risk of injury, or, if such condition exists, it has been fully disclosed in writing to FLHBA and cleared in writing by a licensed physician. I understand that it is my responsibility to consult my child’s physician regarding participation, that my child is covered by valid health and accident insurance, and that I am solely responsible for any costs, losses, or claims arising from inaccurate or incomplete medical information provided by me.
Assumption of Risk
I understand and acknowledge that athletic activities involve inherent risks, including but not limited to sprains, fractures, heat-related illness, concussions, permanent disability, and, in rare cases, death. I understand that while reasonable care, rules, equipment, and supervision may reduce these risks, they cannot eliminate them entirely. On behalf of myself and my child, I knowingly and voluntarily assume all inherent risks of participation, whether known or unknown, to the fullest extent permitted by Florida law. “Inherent risks” are those dangers that are integral to the activity and cannot be eliminated even with the exercise of due care by FLHBA.
Responsibility and Conduct
I accept full responsibility for my child’s participation and agree that my child and I will comply with all stated and customary rules, guidelines, and safety instructions. If I observe any condition that I believe may jeopardize my child’s safety, I will immediately remove my child from participation and notify an FLHBA coach or official.
Release and Waiver of Liability
In consideration for my child being allowed to participate in the Activities, I, on behalf of myself and my child, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE FLHBA and the Released Parties from any and all claims, demands, causes of action, or liability for personal injury, death, or property damage arising out of or related to the inherent risks of participation in the Activities to the fullest extent permitted by Florida law. I agree to indemnify and hold harmless the Released Parties from any claim brought contrary to this release.
“Released Parties” includes FLHBA, its owners, employees, coaches, volunteers, and any other persons or entities associated with the Activities.
Limitation
Nothing in this agreement releases or waives any claim arising from gross negligence or intentional misconduct of a Released Party to the extent such a release is prohibited by Florida law.
Media Release
I hereby grant permission to FLHBA, and any third party FLHBA deems appropriate (including, but not limited to, sponsors and/or licensees of FLHBA), to use the below-named minor’s image, name, voice, and likeness in any form—existing or future—for promotional, commercial, or media purposes (“Works”), worldwide and in perpetuity. I waive any right to compensation for the use of such Works. I understand all such Works are the sole property of FLHBA. FLHBA may share these Works with third parties without advance notice or additional permission.
Acknowledgment
I acknowledge that I have read this Participation Waiver and Release of Liability in its entirety, understand its terms, and recognize that I am waiving substantial legal rights. I sign this agreement knowingly, freely, and voluntarily, without inducement.
